1.          Sub­ject

1.1.      The pur­pose of this Pri­va­cy Pol­i­cy is to inform Users about the nature of the per­son­al data col­lect­ed and processed by The Help­net, as well as the pur­pose of such pro­cess­ing and the rights of Users with respect to the per­son­al data collected. 

1.2.      This Pol­i­cy applies in addi­tion to the Gen­er­al terms and con­di­tions and oth­er doc­u­ments includ­ed in the Con­trac­tu­al Doc­u­men­ta­tion. In the event of any dis­crep­an­cy between the gen­er­al terms and con­di­tions and these terms and con­di­tions, the lat­ter shall prevail.

1.3.      In case of dis­agree­ment with this Pol­i­cy, the User is invit­ed not to use the Site or the Plat­form and not to com­mu­ni­cate his per­son­al data..

1.4.      A sum­ma­ry table of the data col­lect­ed and the pur­pose of the pro­cess­ing is append­ed below.

2.          Col­lect­ed Data

2.1.     Infor­ma­tion col­lect­ed auto­mat­i­cal­ly. When con­sult­ing the Site or using the Plat­form, cer­tain data con­cern­ing the User is col­lect­ed auto­mat­i­cal­ly (IP address, loca­tion, Plat­form pages con­sult­ed, date and time of con­sul­ta­tion, cook­ies or sim­i­lar tech­nolo­gies, brows­er pref­er­ence, oper­at­ing sys­tem, access data, etc.). In addi­tion to the data col­lect­ed direct­ly by The Help­net, cer­tain data may be col­lect­ed by oth­er ser­vice providers such as Google Ana­lyt­ics. Only the pri­va­cy poli­cies of these ser­vice providers apply when they col­lect data and The Help­net can­not be held respon­si­ble for their pro­cess­ing. 2.2.     Infor­ma­tion freely pro­vid­ed by users. The User may be required to pro­vide per­son­al data about him/her in order to be able to take advan­tage of the Ser­vices offered by The Help­net. The data required for use are in particular:

(i)             for all Users: his/her email address, first name, sur­name, date of birth, gen­der, postal address, tele­phone number ;

(ii)            for Cus­tomers and Patients: a means of pay­ment (if he wish­es to launch Ser­vice Requests), a billing address..

(iii)          for Ser­vice Providers: their con­tact details (if they wish to receive pay­ment for their Ser­vice Provider Ser­vices), a copy of a doc­u­ment prov­ing their iden­ti­ty, an extract from the trade reg­is­ter (if reg­is­tered) of the com­pa­ny through which they wish to offer their ser­vices or their cer­tifi­cate of self-employ­ment, copies of their diplo­mas (if their pro­fes­sion is sub­ject to autho­ri­sa­tion), as well as any cer­tifi­cates enabling The Help­net to ensure that the Ser­vice Provider is actu­al­ly autho­rized to prac­tice in the area of the Ser­vice Provider Ser­vices that they wish to offer through the Plat­form. How­ev­er, it is the Ser­vice Provider’s respon­si­bil­i­ty to ensure that the eth­i­cal and deon­to­log­i­cal rules applic­a­ble to it allow it to offer its Ser­vice Provider Ser­vices through the Plat­form. These details are manda­to­ry and their absence may make it impos­si­ble to reg­is­ter and/or pro­vide the Services.

In addi­tion to the data required to access the Ser­vices, option­al data may be pro­vid­ed vol­un­tar­i­ly by the User, such as a pho­to­graph, cen­tres of inter­est, hob­bies, biog­ra­phy, par­tic­i­pa­tion in activ­i­ties, reg­is­tered means of pay­ment, etc. The data nec­es­sary for use (manda­to­ry) are men­tioned in the forms by adding an aster­isk or the impos­si­bil­i­ty of val­i­dat­ing the form with­out fill­ing in the ded­i­cat­ed field.

2.3.     Infor­ma­tion pro­vid­ed by third par­ties. Providers may record “Inter­view Notes” relat­ing to their Clients or Patients. By using the Plat­form, as a Cus­tomer or Patient, you express­ly agree that such infor­ma­tion, even sen­si­tive infor­ma­tion, may be record­ed and processed on the Plat­form. As a Ser­vice Provider, you agree that your “Inter­view Notes” con­cern­ing a Client or a Ser­vice Provider may be sent to them at their request. The Help­net can­not be held respon­si­ble for the data reg­is­tered and man­aged by the Ser­vice Providers.

2.4.     Infor­ma­tion result­ing from the use of the Plat­form. Infor­ma­tion result­ing from the use of the Plat­form. The Help­net will obtain, through your use of the Plat­form, data such as your appoint­ment book­ings, the Providers and Cus­tomers or Patients with whom you have inter­act­ed, etc. The Help­net will not be liable for any data that you may have entered or man­aged by the Providers. This data is nec­es­sary to ensure billing and qual­i­ty of ser­vice for Users.

2.5.     Infor­ma­tion con­cern­ing minors. No data con­cern­ing old­er minors is col­lect­ed. Any data that may be col­lect­ed invol­un­tar­i­ly is destroyed as soon as possible.

3.          Not col­lect­ed Data

3.1.     Gen­er­al. Com­mu­ni­ca­tions between a Ser­vice Provider and a Client or Patient through the Plat­form are encrypt­ed Peer-to-Peer. The Help­net uses part­ner ser­vices to ensure that com­mu­ni­ca­tions between the Provider(s) and Customer(s) or Patient(s) are han­dled as secure­ly as possible.

3.2.     No record­ing of telecom­mu­ni­ca­tion. The Help­net does not have access to and there­fore does not store any data of the exchanges between Providers and Cus­tomers or Patients dur­ing tele­con­sul­ta­tion sub­ject to point 2 (and in par­tic­u­lar 2.3.) above.

4.         Use of col­lect­ed Data

4.1.      Auto­mat­i­cal­ly col­lect­ed data. The data col­lect­ed auto­mat­i­cal­ly allows The Help­net to ana­lyze User behav­ior on the Site, traf­fic and pref­er­ences, in par­tic­u­lar in order to opti­mize and improve the qual­i­ty of its Services..

4.2.      Data pro­vid­ed by Users or third par­ties. The Help­net process­es and uses the data nec­es­sary to ful­fil its con­trac­tu­al oblig­a­tions and to ver­i­fy com­pli­ance with the con­di­tions of use. The pro­cess­ing of this data also makes it pos­si­ble to pro­vide per­son­alised con­tent to bet­ter meet the User’s expectations.

5.          Com­mu­ni­ca­tion and trans­mis­sion of data

5.1.      The User’s per­son­al data will not be passed on to third par­ties with the inten­tion of using them for direct mar­ket­ing pur­pos­es, unless the User has giv­en his or her con­sent to the contrary.

5.2.      The User’s per­son­al data may be trans­mit­ted or com­mu­ni­cat­ed to third par­ties in the fol­low­ing cas­es: (i) for the pur­pose of exe­cut­ing the con­tract between the Cus­tomer or Patient and the Ser­vice Provider. The data col­lect­ed in the con­text of the con­clu­sion of a con­tract between the Cus­tomer and the Ser­vice Provider may also be used for the pur­pos­es of pro­mot­ing sim­i­lar or iden­ti­cal items that may be of inter­est to the User; (ii) in the con­text of pro­vid­ing ser­vices on behalf of The Help­net; (iii) when the User has con­sent­ed to this (in par­tic­u­lar the trans­mis­sion of infor­ma­tion to The Help­net’s finan­cial part­ners in order to be able to exe­cute pay­ments); (iv) dur­ing joint pro­mo­tions or pro­grams with part­ners; (v) when required by law or when com­mu­ni­ca­tion is rea­son­ably nec­es­sary in order to exe­cute a legal deci­sion or to respond to a legal claim; (vi) in the event of a merg­er, acqui­si­tion of the com­pa­ny or shares of the com­pa­ny by anoth­er company.

5.3.      It is remind­ed that the pro­cess­ing of data by third par­ties to whom The Help­net may be required to com­mu­ni­cate data is exclu­sive­ly sub­ject to the pri­va­cy pol­i­cy of said third par­ties. The Help­net can­not be held respon­si­ble for their use.

5.4.      The Help­net reserves the right to anonymise cer­tain data in order to pass them on to third par­ties for research, sta­tis­ti­cal or mar­ket­ing purposes..

6.          Users’ rights

6.1.      Right of access. The User may at any time request access to his/her per­son­al data stored by The Helpnet.

6.2.      Right of rec­ti­fi­ca­tion. The User whose data is inac­cu­rate or incom­plete has the right to have it corrected.

6.3.      Right of with­draw­al and/or oppo­si­tion. The User may at any time object to the col­lec­tion or pro­cess­ing of cer­tain data con­cern­ing him/her (opt­ing out). This oppo­si­tion may result in the ter­mi­na­tion of the use of the Site or the Platform.

6.4.      Right of dele­tion. The User has the right to request the dele­tion of per­son­al data con­cern­ing him/her when their use is no longer nec­es­sary or when the User no longer agrees with the pro­cess­ing of his/her data. Such data will be delet­ed as soon as pos­si­ble, unless oth­er­wise pro­vid­ed by law.

6.5.      Exer­cise of rights. To exer­cise the above rights, the User may make a request at any time to the fol­low­ing address: contac@the-helpnet.ch.

7.          Secu­ri­ty

7.1.      The Help­net takes the pro­tec­tion of its Users’ data very seri­ous­ly and under­takes to treat their per­son­al data con­fi­den­tial­ly and with the utmost care. In par­tic­u­lar, The Help­net takes appro­pri­ate secu­ri­ty mea­sures to pre­vent unau­tho­rised access, dis­clo­sure, mod­i­fi­ca­tion or destruc­tion of the data col­lect­ed. How­ev­er, although some per­son­al data is encrypt­ed, The Help­net can­not guar­an­tee com­plete and full pro­tec­tion of the data against unau­tho­rised pro­cess­ing due to the risks asso­ci­at­ed with the use of the Inter­net and elec­tron­ic means of communication.

8.          Data preser­va­tion

8.1.      Data col­lect­ed by The Help­net is retained for as long as is nec­es­sary for the pur­pose for which it was col­lect­ed, sub­ject to legal pro­vi­sions pro­vid­ing for longer data reten­tion peri­ods. After this peri­od, per­son­al data is deleted.

9.          Amend­ments

9.1.      The Help­net reserves the right to change its Pri­va­cy Pol­i­cy at any time. The mod­i­fi­ca­tions will be pub­lished on the Site and will come into force from the date of posting.

9.2.      The Pri­va­cy Pol­i­cy cur­rent­ly online is applic­a­ble. By con­tin­u­ing to browse the Site or the Plat­form, the User accepts the Pri­va­cy Pol­i­cy in force.
