1. Subject
1.1. The purpose of this Privacy Policy is to inform Users about the nature of the personal data collected and processed by The Helpnet, as well as the purpose of such processing and the rights of Users with respect to the personal data collected.
1.2. This Policy applies in addition to the General terms and conditions and other documents included in the Contractual Documentation. In the event of any discrepancy between the general terms and conditions and these terms and conditions, the latter shall prevail.
1.3. In case of disagreement with this Policy, the User is invited not to use the Site or the Platform and not to communicate his personal data..
1.4. A summary table of the data collected and the purpose of the processing is appended below.
2.1. Information collected automatically. When consulting the Site or using the Platform, certain data concerning the User is collected automatically (IP address, location, Platform pages consulted, date and time of consultation, cookies or similar technologies, browser preference, operating system, access data, etc.). In addition to the data collected directly by The Helpnet, certain data may be collected by other service providers such as Google Analytics. Only the privacy policies of these service providers apply when they collect data and The Helpnet cannot be held responsible for their processing. 2.2. Information freely provided by users. The User may be required to provide personal data about him/her in order to be able to take advantage of the Services offered by The Helpnet. The data required for use are in particular:
(i) for all Users: his/her email address, first name, surname, date of birth, gender, postal address, telephone number ;
(ii) for Customers and Patients: a means of payment (if he wishes to launch Service Requests), a billing address..
(iii) for Service Providers: their contact details (if they wish to receive payment for their Service Provider Services), a copy of a document proving their identity, an extract from the trade register (if registered) of the company through which they wish to offer their services or their certificate of self-employment, copies of their diplomas (if their profession is subject to authorisation), as well as any certificates enabling The Helpnet to ensure that the Service Provider is actually authorized to practice in the area of the Service Provider Services that they wish to offer through the Platform. However, it is the Service Provider’s responsibility to ensure that the ethical and deontological rules applicable to it allow it to offer its Service Provider Services through the Platform. These details are mandatory and their absence may make it impossible to register and/or provide the Services.
In addition to the data required to access the Services, optional data may be provided voluntarily by the User, such as a photograph, centres of interest, hobbies, biography, participation in activities, registered means of payment, etc. The data necessary for use (mandatory) are mentioned in the forms by adding an asterisk or the impossibility of validating the form without filling in the dedicated field.
2.3. Information provided by third parties. Providers may record “Interview Notes” relating to their Clients or Patients. By using the Platform, as a Customer or Patient, you expressly agree that such information, even sensitive information, may be recorded and processed on the Platform. As a Service Provider, you agree that your “Interview Notes” concerning a Client or a Service Provider may be sent to them at their request. The Helpnet cannot be held responsible for the data registered and managed by the Service Providers.
2.4. Information resulting from the use of the Platform. Information resulting from the use of the Platform. The Helpnet will obtain, through your use of the Platform, data such as your appointment bookings, the Providers and Customers or Patients with whom you have interacted, etc. The Helpnet will not be liable for any data that you may have entered or managed by the Providers. This data is necessary to ensure billing and quality of service for Users.
2.5. Information concerning minors. No data concerning older minors is collected. Any data that may be collected involuntarily is destroyed as soon as possible.
3. Not collected Data
3.1. General. Communications between a Service Provider and a Client or Patient through the Platform are encrypted Peer-to-Peer. The Helpnet uses partner services to ensure that communications between the Provider(s) and Customer(s) or Patient(s) are handled as securely as possible.
3.2. No recording of telecommunication. The Helpnet does not have access to and therefore does not store any data of the exchanges between Providers and Customers or Patients during teleconsultation subject to point 2 (and in particular 2.3.) above.
4. Use of collected Data
4.1. Automatically collected data. The data collected automatically allows The Helpnet to analyze User behavior on the Site, traffic and preferences, in particular in order to optimize and improve the quality of its Services..
4.2. Data provided by Users or third parties. The Helpnet processes and uses the data necessary to fulfil its contractual obligations and to verify compliance with the conditions of use. The processing of this data also makes it possible to provide personalised content to better meet the User’s expectations.
5. Communication and transmission of data
5.1. The User’s personal data will not be passed on to third parties with the intention of using them for direct marketing purposes, unless the User has given his or her consent to the contrary.
5.2. The User’s personal data may be transmitted or communicated to third parties in the following cases: (i) for the purpose of executing the contract between the Customer or Patient and the Service Provider. The data collected in the context of the conclusion of a contract between the Customer and the Service Provider may also be used for the purposes of promoting similar or identical items that may be of interest to the User; (ii) in the context of providing services on behalf of The Helpnet; (iii) when the User has consented to this (in particular the transmission of information to The Helpnet’s financial partners in order to be able to execute payments); (iv) during joint promotions or programs with partners; (v) when required by law or when communication is reasonably necessary in order to execute a legal decision or to respond to a legal claim; (vi) in the event of a merger, acquisition of the company or shares of the company by another company.
5.3. It is reminded that the processing of data by third parties to whom The Helpnet may be required to communicate data is exclusively subject to the privacy policy of said third parties. The Helpnet cannot be held responsible for their use.
5.4. The Helpnet reserves the right to anonymise certain data in order to pass them on to third parties for research, statistical or marketing purposes..
6. Users’ rights
6.1. Right of access. The User may at any time request access to his/her personal data stored by The Helpnet.
6.2. Right of rectification. The User whose data is inaccurate or incomplete has the right to have it corrected.
6.3. Right of withdrawal and/or opposition. The User may at any time object to the collection or processing of certain data concerning him/her (opting out). This opposition may result in the termination of the use of the Site or the Platform.
6.4. Right of deletion. The User has the right to request the deletion of personal data concerning him/her when their use is no longer necessary or when the User no longer agrees with the processing of his/her data. Such data will be deleted as soon as possible, unless otherwise provided by law.

7. Security
7.1. The Helpnet takes the protection of its Users’ data very seriously and undertakes to treat their personal data confidentially and with the utmost care. In particular, The Helpnet takes appropriate security measures to prevent unauthorised access, disclosure, modification or destruction of the data collected. However, although some personal data is encrypted, The Helpnet cannot guarantee complete and full protection of the data against unauthorised processing due to the risks associated with the use of the Internet and electronic means of communication.
8. Data preservation
8.1. Data collected by The Helpnet is retained for as long as is necessary for the purpose for which it was collected, subject to legal provisions providing for longer data retention periods. After this period, personal data is deleted.
9. Amendments
9.1. The Helpnet reserves the right to change its Privacy Policy at any time. The modifications will be published on the Site and will come into force from the date of posting.
